Scott Mirsky Provides Commentary for SHRM Concerning the DOL’s Proposal for Independent Contractors

Paley Rothman Employment Law Principal Scott Mirsky was quoted by Leah Shepherd of SHRM for the article, "DOL Issues Proposed Rule on Independent Contractors," on October 12, 2022.

 This piece explores the Department of Labor's (DOL) newest proposal for determining who is qualified as an independent contractor and new factors to be examined with the determination. 

"With the proposed rulemaking, the pendulum shifts more towards a pro-employee definition of employment, [but] it does not swing all the way in that direction," said Scott Mirsky, an attorney with Paley Rothman in Bethesda, Md.
