Jim Hammerschmidt Provides Commentary for Law360 Article on Reimplementing Business Travel and Avoiding Worker Discrimination
Employment Law Chair, Jim Hammerschmidt, provided commentary for an article titled: "Resuming Business Travel May Cause Legal Turbulence" which was published on Law360.com on March 25, 2022.
Jim talked to Law360 about how companies should handle workplace travel assignments so they are sensitive to employees that have concerns related to COVID-19.
Jim notes in the piece, “For employers, to avoid potential claims of employment discrimination, that'll mean having to figure out if a travel assignment is a worker's preference, a perk they receive, or an essential part of their job.”
He adds, “While that analysis is key for employers in determining whether any legal obligations are attached to travel assignments, determining essential components of a worker's job may look far different in 2022 than it did in 2019.”
